The second amendment protects our right to bear arms but over recent history, it’s been attacked more than any other amendment. When these attacks move from verbal disputes to legislative action, though, it’s important to take notice of exactly what is happening.
Most of these legislative measures have been ruled in favor of the second amendment. For instance, in 2002, the United States v. Emerson expanded the right to bear arms to include the right to those who are under a restraining order. In 2009, McDonald v. Chicago deemed that citizens have the right to bear arms within their home. Even stun guns saw protection under the ruling of Caeteno v. Massachusetts.
All in all, these rulings represent one thing: while under attack, the second amendment is thriving and isn’t going anywhere anytime soon.
